Privacy policy

This Privacy Policy describes how information may be collected and/or used by the Laura and John Arnold Foundation® (“LJAF”) in connection with your use of www.psapretrial.org and related content, services, features, and applications (the “Website”). The Website is U.S.-based, and it is intended for and directed at the issue of pretrial risk assessment pertaining to U.S. jurisdictions. This Privacy Policy does not cover information collected on sites, applications, destinations, or services linked to from the Website that LJAF does not own or control.

By registering with the Website or otherwise accessing, visiting or using the Website, you consent to this Privacy Policy. If you do not agree with this Privacy Policy, you should not access, visit, and/or use the Website.

LJAF reserves the right to modify this Privacy Policy at any time. So that you are aware changes have been made, LJAF will adjust the “Last Revised” date at the beginning of this document. If LJAF makes material changes to this policy, LJAF will post a prominent notice on the Website. Your continued use of the Website after any change constitutes your acceptance of any changes to the Privacy Policy.

INFORMATION COLLECTED

LJAF tracks user activity anonymously to develop analytics reports for the Website. LJAF does not allow third-party advertising on the Website. LJAF does not advertise either LJAF or the Website on third party websites. LJAF does not use tracking technologies for online behavioral advertising.

LJAF divides the information it could receive about you into two general categories: (1) website usage information (“Website Information”); and (2) personally identifiable user information (“Personal Information”):

1. Website Information

a. Cookies/Local Device Storage

LJAF may at times place and/or store code or other types of information and/or software on your device or within your browser, such as cookies (including flash cookies), locally shared objects, and HTML5 (collectively, “Local Device Storage”). LJAF may use Local Device Storage to track Website activity, to help diagnose problems with servers, to gather broad demographic information, to conduct research, to deliver content, to record registration and personalization information, and to otherwise administer the Website. If you do not want Local Device Storage, your device or browser may include an option that allows you to not accept it. However, if you disable Local Device Storage, some portions of the Website may not function properly.

b. Tracking Technologies

LJAF may use web beacons, web bugs, internet or pixel tags, clear gifs, digital fingerprinting and similar technologies (collectively, together with Local Device Storage, the “Tracking Technologies”) on the Website and in our communications with you, such as within e-mail and text messages and push notifications. We use Tracking Technologies to determine which of our messages have been opened by recipients, and for all or some of the same lawful purposes we described above for use of Local Device Storage.

c. IP Address & Click Data

LJAF collects information regarding the identity of your Internet Protocol (“IP”) address and click activity. LJAF uses this information for internal system monitoring and to administer the Website. This information may also be used to gather and aggregate broad demographic information and profile data.

2. Personal Information

Depending on the capacity in which a user registers to use the Website, the Website registration process may involve your voluntary submission of some or all of the following information: name; email address; physical address; telephone number; occupation; employer; geographic location.

INFORMATION PROVIDED TO THIRD PARTIES

1. Service Providers

LJAF may use third-party partners to help LJAF operate and maintain the Website. Third-party service providers are contractually restricted from using or disclosing any Website Information or Personal Information except as necessary to perform services on LJAF’s behalf or to comply with legal requirements.

2. Aggregate Statistics

LJAF may disclose non-personally identifiable aggregate statistics regarding user behavior as a measure of interest in, and use of, the Website, such as overall patterns or demographic reports that do not describe or identify any individual user. Information relating to aggregate statistics may be collected through the use of third-party cookies and other third-party tracking devices.

3. Legally Compelled Disclosures

LJAF may disclose any Personal Information you may have chosen to provide if LJAF is required to do so by law, subpoena, or discovery request, or if LJAF believes that such action is necessary to (a) conform to the law, comply with a judicial or court order, or comply with legal process served on us or related third parties; (b) protect and defend LJAF’s rights and property, the Website, users of the Website, and/or related third parties; or (c) act under circumstances to protect the safety of users of the Website, LJAF, or related third parties.

4. Transfer

LJAF reserves the right to transfer any Website Information LJAF has about you in the event of merger or succession. Should such a transfer occur, LJAF will make reasonable efforts to direct the transferee to use Personal Information you have provided through the Website in a manner that is consistent with this Privacy Policy.

ACCESSING THIRD-PARTY SERVICES THROUGH THE WEBSITE

By using the Website to access or connect to a social network or other third-party platform or service (e.g., Facebook, Twitter), you authorize LJAF to collect, store, and use any and all information in the same manner and to the same extent that you agreed the social network or third-party platform could collect, store, or use the information.

MINORS GUIDELINES

The Website is not intended for use by children under the age of 13, and LJAF does not knowingly collect Personal Information from children under the age of 13. If LJAF becomes aware that it has inadvertently received Personal Information from a visitor under the age of 13, LJAF will delete such information from its records.

CONSENT TO WORLDWIDE TRANSFER AND PROCESSING OF WEBSITE INFORMATION AND PERSONAL INFORMATION

The Website is U.S.-based. You agree that any Website Information or Personal Information you may provide to LJAF through the Website may be used for the purposes described herein, and you further understand and consent to the collection, maintenance, processing, and transfer of such information in and to the United States and other countries and territories, which may have different privacy laws from your country of residence and which may afford varying levels of protection for such information.

SECURITY

LJAF shall use commercially reasonable and industry-acknowledged physical, managerial, and technical safeguards to preserve the integrity and security of any Website Information and Personal Information that may be collected in connection with the Website. LJAF cannot, however, guarantee that information, during transmission through the Internet or while stored on our systems or otherwise in our care, will be safe from intrusion by others, such as hackers. LJAF is not liable in any way for disclosure of your Website Information or Personal Information due to errors or unauthorized acts of third parties.
